A glaring manifestation of this systemic rot recently surfaced in Khatauli, Muzaffarnagar, where a massive financial scam was met not with swift police action, but with blatant intimidation and threats of false imprisonment.
At the center of this controversy is an elaborate financial fraud orchestrated by a man named Haji Imran, a resident of Nai Abadi near the Jharkhand Mandir in Khatauli. Capitalizing on the religious sentiments and goodwill of the local community, Imran collected substantial sums of money from approximately 100 to 120 innocent people. The stated objective was noble: the acquisition and construction of a “Kabristan” (graveyard) for the community. However, over two years have elapsed since the funds were collected. No graveyard has materialized, and the hard-earned money of over a hundred families has vanished.
In legal parlance, extracting money under false pretenses and subsequently misappropriating it is a serious criminal offense. Such actions fall squarely within the ambit of Cheating, governed by Section 318 of the Bharatiya Nyaya Sanhita (BNS), 2023, and Criminal Breach of Trust, defined under Section 316 of the BNS. These are cognizable offenses that mandate an immediate and thorough police investigation.
Stepping up to aid the defrauded citizens was Arif Malik, a resident of Khatauli and a dedicated pro bono worker for the Human Rights Welfare and Justice Association. Operating strictly on humanitarian grounds, Malik sought to initiate legal proceedings against the accused to recover the community’s stolen funds. On August 30, 2026, he visited the Khatauli Police Station to lodge a formal complaint and register a First Information Report (FIR).
What should have been a standard administrative procedure quickly deteriorated into an egregious display of police misconduct. Instead of taking cognizance of the massive fraud, the Station House Officer (S.H.O.), Inspector Dinesh Bagel, subjected Malik to extreme misbehavior. Abandoning all protocols of democratic policing, Inspector Bagel categorically refused to register the complaint. Shockingly, he escalated the confrontation by explicitly threatening to frame Malik in false and fabricated criminal cases if he dared to pursue the matter or return to the police station.
This appalling incident of police high-handedness sent shockwaves through the local human rights community. Intimidating a social worker to shield a fraudster is an intolerable abuse of power. Realizing that local authorities were actively subverting justice, high-level intervention became absolutely necessary.
Refusing to let this travesty go unchallenged, Mr. Piyush Sharma, the Director of the Human Rights Welfare and Justice Association, alongside Advocate Anmol Sharma from the prominent Delhi-based Jagdish Law Firm, immediately took charge of the situation. Outside the S.S.P. office, they recorded a powerful video exposing Inspector Bagel’s refusal to discharge his statutory duties and his brazen threats against a human rights defender. Bringing the matter directly to the district’s top law enforcement official was a necessary tactical strike against the Khatauli police’s corruption. Acting strictly upon the administrative directions provided by the S.S.P. office, the team subsequently dispatched a comprehensive formal complaint against S.H.O. Dinesh Bagel via Speed Post, ensuring a documented paper trail of his administrative failures.
Advocate Anmol Sharma is fully prepared to escalate the legal battle using the rigorous provisions of the newly implemented Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. Under the updated criminal procedure framework, police officers cannot arbitrarily suppress crime reporting. If an officer in charge refuses to register an FIR, the aggrieved party has the statutory mechanism to escalate the grievance directly to the Superintendent of Police under Section 173(4) of the BNSS. Should the police machinery still fail to initiate an investigation, the law empowers the victims to file a direct application before the judicial Magistrate under Section 175(3) of the BNSS. The Magistrate holds the authority to legally compel the police to register the FIR and thoroughly investigate the matter.
